Terms of Use
The rules and responsibilities for using the Transport-Wise platform and services.
Summary: By using Transport-Wise you agree to these terms. Transport-Wise is a marketplace — we connect customers with carriers but are not a party to transport contracts. You are responsible for your listings, bids, and the accuracy of information you provide.
01 About the Platform
Transport-Wise ("we", "us", "our") operates an online freight marketplace at transport-wise.com that enables customers ("Customers") who need goods transported to post job listings and receive competitive bids from independent transport carriers ("Carriers").
Transport-Wise is a marketplace intermediary only. We do not carry, handle, or insure goods. We are not a party to any transport contract formed between a Customer and a Carrier. The transport contract is formed directly between those two parties when a bid is accepted.
By creating an account and using the platform you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.
02 Eligibility
To use Transport-Wise you must:
- Be at least 18 years of age
- Be a legal entity or individual with legal capacity to enter into a binding contract
- Provide accurate and truthful registration information
- Not have been previously suspended or removed from the platform
Carriers must additionally hold all licences, permits, and insurance required by law in the jurisdiction(s) in which they operate. By registering as a Carrier you confirm that you meet and will maintain these requirements throughout your use of the platform.
03 Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out under your account. You must notify us immediately if you become aware of any unauthorised access to your account.
You agree to:
- Provide accurate, current, and complete information during registration and keep it up to date
- Not share your account credentials with any third party
- Not use another user's account without their explicit permission
- Not create multiple accounts to circumvent restrictions or bans
We reserve the right to suspend or terminate accounts that violate these terms, without prior notice where we reasonably consider it necessary to protect users or the platform.
04 Customer Responsibilities
As a Customer posting jobs on Transport-Wise, you agree to:
- Provide an accurate and complete description of the goods to be transported, including weight, dimensions, quantity, and any special handling requirements
- Disclose any hazardous, restricted, or regulated nature of the goods
- Ensure goods are appropriately packaged and ready for collection at the agreed time
- Pay the agreed bid amount in accordance with the payment terms
- Only post jobs for lawful goods and lawful transport purposes
Customers are solely responsible for the accuracy of job listings. Inaccurate listings that cause loss or additional cost to a Carrier may result in the Customer bearing liability for those costs, independent of any Transport-Wise involvement.
05 Carrier Responsibilities
As a Carrier operating on Transport-Wise, you agree to:
- Hold and maintain all necessary transport licences, operator permits, and insurance — including public liability and goods-in-transit insurance — as required by law
- Only bid on jobs you are genuinely able and qualified to complete
- Provide accurate information about your vehicle(s) and capacity
- Collect and deliver goods with reasonable care and within the agreed timeframe
- Communicate promptly with Customers regarding any delays or issues
- Not subcontract or reassign a job to a third party without the Customer's explicit consent
Transport-Wise does not verify every piece of information Carriers provide but reserves the right to request documentation at any time and to suspend Carriers who cannot demonstrate compliance.
06 The Bidding Process
When a Carrier submits a bid, that bid constitutes a binding offer to complete the job at the stated price and conditions. When a Customer accepts a bid, a direct transport contract is formed between the Customer and the Carrier. Transport-Wise is not a party to that contract.
Bids are subject to the following rules:
- Bids must be genuine and reflect the Carrier's actual intention to complete the work
- Bid manipulation, collusion between Carriers, or placing bids with no intention to complete the job is prohibited and may result in permanent suspension
- Once a bid is accepted by a Customer, the Carrier may not unilaterally withdraw without good cause
- A Customer may withdraw an accepted bid only where the Carrier has materially breached the agreed terms
07 Payments & Fees
Payments on the platform are processed by Stripe, a third-party payment processor. By using payment functionality you also agree to Stripe's terms of service.
A refundable deposit may be required from Customers upon accepting a bid to confirm their commitment. Deposit and fee structures are displayed clearly before you confirm any payment.
Transport-Wise charges a service fee on completed transactions. Current fee rates are displayed on the platform and may be updated with notice. Fees are non-refundable once a job is marked as completed unless there has been a platform error.
In the event of a dispute over payment, you should follow the process described in our Dispute Resolution Policy.
08 Prohibited Conduct
You must not use Transport-Wise to:
- Transport prohibited, illegal, or regulated goods (including but not limited to controlled substances, weapons, counterfeit goods, or items that violate export controls)
- Circumvent fees or attempt to conduct transactions outside the platform after an initial introduction through Transport-Wise
- Post false, misleading, or fraudulent job listings or bids
- Harass, threaten, or abuse other users
- Collect or harvest personal data of other users for any purpose
- Attempt to access systems or data you are not authorised to access
- Use automated tools, bots, or scripts to interact with the platform in a way that is disruptive or unfair
- Impersonate any person or misrepresent your affiliation with any entity
Breach of any of these prohibitions may result in immediate account suspension, permanent ban, and/or referral to relevant authorities.
09 Liability
Transport-Wise provides a marketplace platform on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, express or implied, in relation to the platform and its content.
Transport-Wise is not liable for:
- Loss of, damage to, or delay in delivery of goods transported by a Carrier
- Any direct transport contract between a Customer and Carrier
- The accuracy of listings, bids, profiles, or reviews posted by users
- Loss of profit, revenue, business, data, or goodwill arising from use of (or inability to use) the platform
- Any act or omission of a Carrier or Customer
Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
Where liability cannot be excluded, our total aggregate liability to you for all claims arising from these terms shall not exceed the greater of £100 or the total fees you paid to Transport-Wise in the three months preceding the claim.
10 Intellectual Property
The Transport-Wise platform, brand, logos, design, and content are owned by or licensed to Transport-Wise and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the platform without our prior written consent.
By posting content on the platform (including job listings, profile information, photographs, and reviews), you grant Transport-Wise a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content solely for the purpose of operating and improving the platform.
11 Termination
You may close your account at any time by contacting us or using the account settings. Closing your account does not affect any outstanding obligations — for example, a Carrier who has accepted a job remains obligated to complete it.
We may suspend or terminate your account without prior notice if you breach these terms, if we reasonably suspect fraud or illegal activity, or if required by law. In non-urgent cases we will give you reasonable notice and an opportunity to respond.
Upon termination, your access to the platform will be revoked. We will retain your data as described in our Privacy Policy.
12 Governing Law
These Terms of Use are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you reside in another jurisdiction and applicable consumer protection law gives you the right to bring proceedings in your local court.
If any provision of these terms is found to be unenforceable, it shall be modified to the minimum extent necessary to make it enforceable. The remaining provisions shall continue in full force and effect.
